Exceptions to the Rule The Politics of Filibuster Limitations in the U.S.

Special rules enable the Senate to act despite the filibuster. Sometimes.

Most people believe that, in today's partisan environment, the filibuster prevents the Senate from acting on all but the least controversial matters. But this is not exactly correct. In fact, the Senate since the 1970s has created a series of special rules-described by Molly Reynolds as majoritarian exceptions”-that limit debate on a wide range of measures on the Senate floor.

The details of these exemptions might sound arcane and technical, but in practice they have enabled the Senate to act even when it otherwise seemed paralyzed. Important examples include procedures used to pass the annual congressional budget resolution, enact budget reconciliation bills, review proposals to close military bases, attempt to prevent arms sales, ratify trade agreements, and reconsider regulations promulgated by the executive branch.

Reynolds argues that these procedures represent a key instrument of majority party power in the Senate. They allow the majority-even if it does not have the sixty votes needed to block a filibuster-to produce policies that will improve its future electoral prospects, and thus increase the chances it remains the majority party.

As a case study, Exceptions to the Rule examines the Senate's role in the budget reconciliation process, in which particular congressional committees are charged with developing procedurally protected proposals to alter certain federal programs in their jurisdictions. Created as a way of helping Congress work through tricky budget issues, the reconciliation process has become a powerful tool for the majority party to bypass the minority and adopt policy changes in hopes that it will benefit in the next election cycle.

Mr. Speaker! The Life and Times of Thomas B. Reed, the Man Who Broke the Filibuster【電子書籍】[ James Grant ]

James Grant’s enthralling biography of Thomas B. Reed, Speaker of the House during one of the most turbulent times in American historyーthe Gilded Age, the decades before the ascension of reformer President Theodore Rooseveltーbrings to life one of the brightest, wittiest, and most consequential political stars in our history.

The last decades of the nineteenth century were a volatile era of rampantly corrupt politics. It was a time of both stupendous growth and financial panic, of land bubbles and passionate and sometimes violent populist protests. Votes were openly bought and sold in a Congress paralyzed by the abuse of the House filibuster by members who refused to respond to roll call even when present, depriving the body of a quorum. Reed put an end to this stalemate, empowered the Republicans, and changed the House of Representatives for all time.

The Speaker’s beliefs in majority rule were put to the test in 1898, when the sinking of the U.S.S. Maine in Havana Harbor set up a popular clamor for war against Spain. Reed resigned from Congress in protest.

A larger-than-life character, Reed checks every box of the ideal biographical subject. He is an important and significant figure. He changed forever the way the House of Representatives does its business. He was funny and irreverent. He is, in short, great company. “What I most admire about you, Theodore,” Reed once remarked to his earnest young prot?g?, Teddy Roosevelt, “is your original discovery of the Ten Commandments.”

After he resigned his seat, Reed practiced law in New York. He was successful. He also found a soul mate in the legendary Mark Twain. They admired one another’s mordant wit. Grant’s lively and erudite narrative of this tumultuous eraーthe raucous late nineteenth and early twentieth centuriesーis a gripping portrait of a United States poised to burst its bounds and of the men who were defining it.

The Legacy of the Filibuster War National Identity and Collective Memory in Central America【電子書籍】[ Marco Cabrera Geserick ]

The Legacy of the Filibuster War: National Identity and Collective Memory in Central America analyzes the development of the Filibuster War as a symbol of Costa Rican national identity and presents several challenges to traditional theories of modernization and the creation of nationalism. By focusing on the development of cultural features defined by the transformation of collective memory, Marco Cabrera Geserick argues that national identity is a dynamic process defined according to local, national, and international contexts. Modernization theories connect the creation of symbols of official nationalism with the period of consolidation of the nation-state, yet the Filibuster War started its rise to Costa Rican national identity years later. Cabrera Geserick analyzes the threats to sovereignty and imperialist advances that served to promote the memory of the Filibuster War, while local social transformationsーsuch as the abolition of the army, the rise of popular forces, and internal political conflictーhave continued to force drastic changes on the interpretation of the war.

Essential Guide to the Senate Filibuster and Cloture Controversy: Partisan Arguments about Rules Which Delay or Block Important Legislation - History, Issues for Today, Proposals for Reform, Confirmation Holds, Leverage, Consequences【電子書籍】

Professionally converted for accurate flowing-text e-book format reproduction, this unique book reproduces important documents, reports, and studies dealing with the controversial issue of Senate filibusters and the cloture rule. Using the filibuster to delay or block legislative action has a long history. The term filibusterーfrom a Dutch word meaning "pirate"ーbecame popular in the 1850s, when it was applied to efforts to hold the Senate floor in order to prevent a vote on a bill.

Contents: Filibuster and Cloture * Filibusters and Cloture in the Senate Report * Examining the Filibuster * Hearings Before the Committee on Rules and Administration * DAY 1) April 22, 2010 - Examining The Filibuster * DAY 2) May 19, 2010 - Examining The Filibuster: The Filibuster Today And Its Consequences * DAY3) June 23, 2010 - Examining The Filibuster: Silent Filibusters, Holds And The Senate Confirmation Process * DAY 4) July 28, 2010 - Examining The Filibuster: Legislative Proposals To Change Senate Procedures * DAY 5) September 22, 2010 - Examining The Filibuster: Legislative Proposals To Change Senate Procedures * DAY 6) September 29, 2010 - Examining The Filibuster: Ideas To Reduce Delay And Encourage Debate In The Senate * Senate Cloture Rule Report * Part 1 - Limitation of Debate in the Senate of the United States * Part 2 - Legislative History of Paragraph 2 of Rule XXII of the Standing Rules of the United States Senate (Cloture Rule) * Changing the Senate Cloture Rule at the Start of a New Congress - Some topics covered in the reports: The Right to Debate * The Right to Recognition * The Right to Speak at Length and the Two-Speech Rule * The Motion to Table * The Conduct of Filibusters * Germaneness of Debate * Yielding the Floor and Yielding for Questions * Quorums and Quorum Calls * Roll Call Voting * Scheduling Filibusters * Invoking Cloture * Matters on Which Cloture May Be Invoked * Timing of Cloture Motions * Effects of Invoking Cloture * Time for Consideration and Debate * Offering Amendments and Motions * Germane Amendments Only * Amendments Submitted in Advance * Multiple Amendments * Dilatory Amendments and Motions * Reading and Division of Amendments * The Authority of the Presiding Officer * Business on the Senate Floor * The Impact of Filibusters * Impact on the Time for Consideration * The Prospect of a Filibuster * Holds * Linkage and Leverage * Consensus

The ability of Senators to engage in filibusters has a profound and pervasive effect on how the Senate conducts its business on the floor. In the face of a threatened filibuster, for example, the majority leader may decide not to call a bill up for floor consideration or may defer calling it up if there are other, equally important bills the Senate can consider and pass with less delay. Similarly, the prospect of a filibuster can persuade a bill's proponents to accept changes in the bill that they do not support but that are necessary to prevent an actual filibuster.

Reform-minded Senators have generally viewed the opening of a new Congress as a special constitutional time that permits the Senate to amend its procedures by majority vote unencumbered by chamber rules adopted by a previous Congress. They cite the U.S. Constitution (Article I, Section 5) as their authority: "Each House may determine the Rules of its Proceedings," which implicitly means by majority vote, state the reformers. Opponents reject this assertion and point out that the Senate has adopted rules, and the Constitution says nothing about the vote required to adopt those rules. Moreover, the Senate is a continuing body with continuing rules.

Defending the Filibuster The Soul of the Senate【電子書籍】[ Richard A. Arenberg ]

This award-winning study of today’s filibuster debate provides a historical overview of Senate rules and an updated analysis of recent controversies.

In an age of increasingly divided partisan politics, many argue that the Senate filibuster is undemocratic or even unconstitutional. Recent legislative disputes have brought criticism of Senate rules into sharp relief, and demands for abolition or reform of the filibuster have increased. In Defending the Filibuster, two experts on Senate procedureーa veteran Senate aide and a former Senate Parliamentarianーargue that the filibuster is fundamental to protecting the rights of the minority in American politics. Richard A. Arenberg and Robert B. Dove provide an instructive historical overview of the development of Senate rules, describe related procedures and tactics, and argue passionately for measured reforms.

Thoroughly updated, this edition includes a new chapter recounting the events of 2012?13 that led to the first invocation of the "nuclear option" to restrict the use of the filibuster for presidential nominations, as well as a new foreword by former US Senator Olympia Snowe. The authors offer a stimulating assessment of the likelihood of further changes in Senate procedure and make their own proposals for reform.

Winner, 2012 ForeWord Reviews Book of the Year, Gold Medal in Political Science

Filibustered! How to Fix the Broken Senate and Save America【電子書籍】[ Jeff Merkley ]

The U.S. Senator from Oregon who is leading the fight to restore the talking filibuster explains how changing just one rule could save our democracy

In a compelling and powerfully argued book, Senator Jeff Merkley and his longtime chief of staff tell the insiders’ story of how the Senate used to work and how the filibuster came to cripple the self-styled “World’s Greatest Deliberative Body” with paralyzing gridlock. And they make the surprising case that restoring a modified version of the old-style, talking filibuster may just be our democracy’s path back from the brink.

For nearly two centuries, the Senate designed by the Founders served the purpose they envisioned: it was a deliberative legislative body where the nation’s thorniest challenges were hashed out. Senators had the ability to speak at length and offer any manner of amendments to influence bills, and then when all had had a say, the Senate voted. Senators who objected to passing a bill could wage a defiant filibusterーin the spirit of fictional Senator Smith who talked until he collapsed in order to block a corrupt railroad deal in the classic 1939 film Mr. Smith Goes to Washington. But at the end of the day, nearly all legislation, amendments, and nominations went to a vote, and the majority prevailed.

Today, however, thanks to abuse of a fifty-year-old reform intended to make it easier for the Senate to pass legislation, the exceedingly difficult, rare filibuster has morphed, plunging the Senate into dysfunction and threatening the very foundations of our democracy. Now, the minority party can simply declare a “no-talk” filibuster, insisting on a supermajority of sixty votes to pass nearly any bill or a lengthy process to confirm any of the president’s nomineesーgiving themselves a veto over the majority’s agenda. Wildly popular bills languish, judgeships and administrative posts remain unfilled, but ordinary citizens can’t see why because the obstruction all takes place behind closed doors.

Filibustered! combines a marvelous romp through key moments in filibuster historyーfrom the first filibuster in 1841 through Southern Dixiecrat filibusters of civil rights legislation, up through Mitch McConnell’s transformation of the filibuster into a routine tool of perennial gridlockーwith firsthand accounts of recent high-profile legislative fights, and a compelling argument that the key to the Senate’s future may be found in its past.
